Terms of Use

1. Who We Are

BingeAway is operated by AMVEN t/a BingeAway, a UK-based company.

2. Eligibility

• You must be at least 16 years old to create an account and use BingeAway.
• By registering, you confirm that you meet this age requirement.
• BingeAway does not knowingly collect or process personal data from anyone under 16. If we become aware of such an account, it will be removed.
• You must be a human. Accounts created by automated means are not permitted.

3. Your Account

• You are responsible for maintaining the security of your account credentials. Do not share your password.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information at registration. You may use a pseudonym as your display name.
• You must notify us immediately at DPO@Amven.uk if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use BingeAway to:

• Post content that is unlawful, defamatory, harassing, abusive, threatening, or obscene.
• Infringe any third party's intellectual property rights (copyright, trademarks, etc.).
• Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or any other malicious code.
• Scrape, crawl, or otherwise extract data from BingeAway without written permission.
• Attempt to gain unauthorised access to any part of the platform or its servers.
• Use the platform for any commercial purpose without our prior written consent.
• Manipulate, spam, or artificially inflate ratings or reviews.

5. Your Content

BingeAway allows you to post reviews, ratings, watchlists, comments, and other content ("User Content").

• You retain ownership of your User Content.
• By posting User Content, you grant BingeAway a non-exclusive, royalty-free, worldwide licence to display and distribute that content within the platform.
• You are solely responsible for ensuring your User Content does not violate any laws or third-party rights.
• We reserve the right to remove any User Content that violates these terms, without prior notice.
• If you delete your account, your reviews may be anonymised rather than deleted if they form part of community discussions.

6. Subscriptions & Payments

• BingeAway offers both a free tier and paid subscription plans (Binger, Power Binger, Binge Master).
• Paid subscriptions are billed via Stripe. By subscribing, you agree to Stripe's terms of service.
• Subscription fees are charged in advance on a monthly or annual basis, as selected at checkout.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are issued unless required by law.
• Prices are displayed inclusive of applicable taxes. We reserve the right to change pricing with 30 days' notice to active subscribers.
• Refunds may be issued at our discretion. To request a refund, contact DPO@Amven.uk.

7. Advertising (Free Tier)

• The free tier of BingeAway is supported by non-personalised advertising served via Google AdSense.
• By using the free tier and accepting our cookie consent, you agree to the placement of advertising cookies as described in our Privacy Policy.
• Paid subscribers (Binger and above) do not receive advertisements.
• We do not endorse the products or services advertised. Third-party advertisers are solely responsible for their content.

8. Intellectual Property

• The BingeAway name, logo, platform design, and all original content produced by AMVEN t/a BingeAway are our intellectual property and may not be reproduced without permission.
• Film and TV information displayed on BingeAway may be sourced from third-party databases (e.g., TMDB, TVmaze). All rights in that content belong to their respective owners.
• We do not claim ownership over film or TV titles, posters, descriptions, or other media metadata.

9. Third-Party Services

BingeAway integrates with third-party services including:

• TMDB — movie data and images
• TVmaze — TV show data
• Stripe — payment processing
• Google AdSense — advertising (free tier)
• Google Analytics — anonymised usage analytics

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

10. Disclaimers

• BingeAway is provided "as is" without warranties of any kind, express or implied.
• We do not warrant that the platform will be uninterrupted, error-free, or free from viruses.
• Ratings and reviews on BingeAway reflect the opinions of individual users and do not constitute professional recommendations.

11. Limitation of Liability

To the maximum extent permitted by law:

• AMVEN t/a BingeAway shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
• Our total liability for any claim arising from these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
• Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Termination

• You may delete your account at any time via your account settings or by contacting DPO@Amven.uk.
• We may suspend or terminate your account without notice if you violate these terms, engage in fraudulent activity, or if we are required to do so by law.
• On termination, your right to use the platform ceases immediately. Sections 5, 8, 10, and 11 survive termination.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email or via an on-site notice at least 14 days before the changes take effect. Continued use of BingeAway after that date constitutes acceptance of the updated terms.
